Ensuring Workplace Safety: Reporting Notifiable Incidents

When a serious incident occurs in the workplace, you as the employer may be required to notify the incident to SafeWork NSW under WHS laws.

What is a notifiable incident?

Notifiable incidents are serious incidents that results or could have resulted in a serious injury. These incidents could involve an employee, but may also involve contractors, volunteers, customers, patrons, visitors or guests.

Under WHS legislation, a ‘notifiable incident’ includes:

  • The death of a person
  • A serious injury or illness
  • A potentially serious incident, or a 'near miss'

WHS Law Requirements & Notifying:

  • Report a ‘notifiable incident’ to the regulator immediately upon awareness.
  • Provide written notification within 48 hours if requested by the regulator.
  • Preserve the incident site until an inspector arrives or gives further directions (with some exceptions).

When you call SafeWork NSW they generally want to know:

  • What happened?
  • Have any persons involved in the incident received the right medical attention? (if required)
  • What steps has been taken to make the scene safe?
  • What actions have been done or are planned to be done to rectify the issue, so the incident is not repeated?

Remember, failing to report a ‘notifiable incident’ is an offence and can result in penalties. If unsure about whether an incident is notifiable, contact your regulator for guidance. Stay compliant and keep your workplace safe.
